Terms of Service

1. Agreement to Terms

By accessing or using Novabuild Agency's services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services. These terms apply to all clients, visitors, and users of our services.

2. Services

Novabuild Agency provides AI-native software development services, including web application development, mobile application development, API development, and product strategy consulting. The scope of services for each engagement is defined in a Statement of Work agreed upon by both parties.

3. Payment Terms

All projects are quoted at a fixed price prior to commencement. We require a 50% deposit before work begins, with the remaining balance due upon delivery. All fees are non-refundable once work has commenced unless otherwise agreed in writing.

4. Intellectual Property & Ownership

Upon full payment, the client receives full ownership of all custom code, designs, and deliverables produced during the engagement. Novabuild Agency retains the right to display completed work in its portfolio unless otherwise agreed in writing.

5. Confidentiality

Both parties agree to keep confidential any proprietary information shared during the engagement. Novabuild Agency will not disclose client business plans, technical specifications, or sensitive information to third parties without written consent. We are happy to sign an NDA upon request.

6. Limitation of Liability

Novabuild Agency's liability is limited to the fees paid for the specific engagement. We are not liable for indirect, incidental, or consequential damages. We make no warranties, express or implied, regarding the fitness of deliverables for any particular purpose beyond what is specified in the agreed scope.

7. Termination

Either party may terminate an engagement with 7 days written notice. The client is responsible for payment for all work completed up to the termination date. Novabuild Agency will deliver all completed work and assets upon receipt of payment.
